【大..;11月22日讯】受人尊重的律师指中共侵犯人权

令人尊敬的中国律师-高智晟先生,在2005年10月18日发表了致中共领导人胡锦涛和温家宝的公开信,要求停止在中国大陆对法轮功修炼者的迫害。

2005年11月5 日,中共当局通知高先生他的律师事务所将被停业一年, 以便当局调查所谓的高先生两件违反法律的做法。

这所谓的违法的事情一是高先生曾给另外一个律师事务所的一位律师出示违法档, 另一件是高先生在他的事务所搬迁后没有向当局注册。

中共当局给高先生15天的时间,要求他承认并改正这些违法的指控,否则的话他的律师事务所将会被无限期停业。

高先生坚持说他从来没有发出任何违法档,并且曾多次试图注册他的新地址,但是中共当局多次不予理睬。 高先生认为当局对他采取这种态度是因为他为法轮功代言,并且宣导人权。

高先生相信中国当局对他的指控是因为他发表了给胡锦涛和温家宝的公开信。

作为设在北京的律师事务所的负责人,高先生曾接到无数来自法轮功学员的申诉,申诉他们在中国员警及监狱受到的迫害和折磨。这些陈述叙述了自1999年七月由前中共主席江泽民发动了对法轮功的迫害后法轮功学员的经历。

高先生为了得到真象,曾秘访山东,那里是中共践踏人权和迫害最严重的地区之一,高先生和他的同事发现对法轮功学员的迫害还在继续。

基于高先生收到的这些申诉的严重性,一个独立和公正的调查是非常必要的。这些申诉值得国际人权组织的关注。中共当局对高先生的指控不应该遮掩问题的关键,即对大陆法轮功学员基本人权的践踏。只有全面,独立和公正的调查才能符合对真理和正义的追求。高先生的努力或许是调查对法轮功学员迫害真相的催化剂。

如果对法轮功学员的迫害和折磨不是真实的话,那么中共当局就应该允许独立和公正的调查。 没有合理理由的不让步,拖延及不愿意接受调查只能更让人推理对法轮功学员的迫害是真实存在的。

Respected Chinese Lawyer Confronts Chinese Communist Party with Allegations of Human Rights Abuses

The respected Chinese lawyer, Mr Gao Zhisheng, recently sent an open letter to the Chinese Communist Party leaders, Messrs Hu Jintao and Wen Jiabao, on 18 October 2005 demanding an end to the persecution of Falun Dafa practitioners in Mainland China.

On 5 November 2005, the Chinese authorities informed Mr Gao that his business would be closed down for one year to enable the authorities to investigate two alleged violations of the law against Mr Gao.

The alleged violations were that Mr Gao had issued an illegal document containing classified information to a lawyer from a different law firm, and that Mr Gao had failed to register his new location after shifting his premises.

The Chinese authorities gave Mr Gao fifteen (15) days to admit to and correct the alleged violations, or his law firm would be shut down indefinitely.

Mr Gao insists that he never issued any illegal document, and tried to register his new business many times but was repeatedly ignored by the Chinese authorities. Mr Gao is of the view that this may be because he was a lawyer who represented Falun Dafa practitioners and someone who advocated for human rights.

Mr Gao is certain that the allegations made against him by the Chinese authorities have been made as a direct result of his open letter addressed to Hu Jintao and Wen Jiabao.

Head of a Beijing-based legal office, Mr Gao reported receiving numerous accounts from Falun Dafa practitioners of torture and abuse at the hands of Chinese police and prison officials. The accounts received span the period of persecution of Falun Dafa practitioners in Mainland China initiated by former Chinese Premier, Jiang Zemin, on 20 July 1999.

Mr Gao investigated the claims of torture and abuse by travelling in secret to Shandong province, which he says is one of the areas where the human rights abuses are most brutal. Mr Gao said he and his colleagues discovered that the torture and abuse of Falun Dafa practitioners continues.

The very serious nature of the complaints received by Mr Gao requires an independent and impartial investigation. They merit the attention of various international human rights organisations. The allegations made by the Chinese authorities concerning Mr Gao’s alleged violations of the law should not obscure the real issue of alleged fundamental human rights abuses committed against Falun Dafa practitioners in Mainland China. Only a comprehensive, independent and impartial investigation will satisfy the desire for truth and justice. Mr Gao’s efforts may well prove to be a catalyst for ascertaining the truth in this matter.

If there is no truth to the allegations of torture and mistreatment of Falun Dafa practitioners, then the Chinese authorities should be prepared to allow an independent and impartial investigation. Intransigence, or delay, or unwillingness without good reason, on their part can only invite the inference that there is substance to the complaints made by Falun Dafa practitioners.
